Judges Have Leeway on Forfeiture Deadlines, Justices Say (1)

The US Supreme Court ruled against a New York man fighting a court order that forced him to forfeit his car and cash long after he was sentenced for a string of violent robberies.

In a unanimous decision on Wednesday, the court said federal trial courts can issue criminal forfeiture orders outside the deadline set in the Federal Rules of Criminal Procedure.

The deadline is intended “as a spur to prompt action, not as a bar to tardy completion,” Justice Sonia Sotomayor wrote in her opinion for the court.
