Judge Defends Fifth Circuit Abortion Pill Ruling After Reversal

Fifth Circuit Judge James Ho is defending the court’s decisions in earlier litigation on the abortion medication mifepristone, after the US Supreme Court reversed the circuit’s ruling in favor of those challenging access to the pill.

A US Court of Appeals for the Fifth Circuit panel on Monday said it was remanding the case back to a North Texas trial court, after the Supreme Court in June said in anti-abortion doctors and organizations that sued didn’t prove they were injured by the FDA’s authorizations for the pill.
