Intellistop Loses Appeal, Denied DOT Exemption for Brake Lights

Intellistop Inc. lost its appeal requesting the DC Circuit review the US Department of Transportation’s decision to deny the company an exemption for its pulsing brake lights.

The US Court of Appeals for the District of Columbia Circuit denied Intellistop’s petition Friday, holding the Federal Motor Carrier Safety Administration acted reasonably in denying the petition, and didn’t mischaracterize Intellistop brake light modules’ possible safety benefits.

Intellistop didn’t address concerns over driver confusion stemming from the product’s rapid introduction, nor concerns that the module altered the performance of original equipment manufacturers’ lights, the per curiam opinion said.
