Intel Subsidiary Altera Likely to File for Rehearing

Altera is now more likely to file for a rehearing of the Ninth Circuit’s cost-sharing decision because Judge Susan Pia Graber has been drawn as a replacement for deceased Judge Stephen Roy Reinhardt.

Judge Reinhardt, who ruled with the majority in favor of the IRS, died between oral arguments and the issuance of the decision.

Judge Graber was picked to replace Judge Reinhardt by the clerk of the U.S. Court of Appeals for the Ninth Circuit on Aug. 2.
