Altera is now more likely to file for a rehearing of the Ninth Circuit’s cost-sharing decision because Judge Susan Pia Graber has been drawn as a replacement for deceased Judge Stephen Roy Reinhardt.
Judge Reinhardt, who ruled with the majority in favor of the IRS, died between oral arguments and the issuance of the decision.
