Inmate’s Sex-Reassignment Surgery Suit Sees 5th Cir. Setback

A transgender woman who sued members of Texas’ Correctional Managed Healthcare Committee after she was denied sex-reassignment surgery failed to explain how the defendants were connected to enforcing the prison’s allegedly unconstitutional policies, the Fifth Circuit said Friday.

The committee members might help to develop the allegedly unconstitutional policies and procedures, but the complaint doesn’t sufficiently allege that they were responsible for enforcing it, the U.S. Court of Appeals for the Fifth Circuit said in a per curiam opinion.
