A Florida inmate’s claim that his civil rights were violated when corrections officers beat him excessively in his cell after he submitted to them is entitled to go to trial, the Eleventh Circuit said Thursday.
Material issues of fact exist regarding whether Allen Pullen resisted the officers and the amount of force used during the incident, the unpublished per curiam opinion said.
Pullen claimed that while he was cleaning his cell, the officers entered, sprayed him with a chemical, placed him on the ground with his hands behind his back, and hit him over 200 times.
