Indiana Law Firm Shielded From Malpractice Claim, 7th Cir. Says

A pallet company that underwent an ownership change is barred from pursuing a legal malpractice claim against Indiana law firm May Oberfell Lorber, because allowing the claim would be an unlawful “assignment,” the Seventh Circuit affirmed Wednesday.

Duro Inc. had three shareholders involved in numerous lawsuits that led to minority shareholder Amit Shah taking over the company. Before taking over, Shah filed a shareholder derivative claim of legal malpractice against Duro’s law firm, May Oberfell. After Shah took over, Duro had only one asset—the legal malpractice claim.
