Indiana City’s Sign Ordinance Survives First Amendment Challenge

Billboard company GEFT Outdoor LLC’s First Amendment challenge to an ordinance that prevented it from placing its signs in Evansville, Ind., was rejected by the Seventh Circuit.

GEFT has been waging a war against sign ordinances throughout Indiana that were preventing it from placing its digital billboards in the jurisdictions it wanted to.

GEFT challenged here the Evansville law that makes a distinction between signs located on the premises of what’s being advertised, and off-premises signs. The district court’s original ruling that the distinction was content discrimination was previously reversed.
