A Mexican citizen convicted of using an unauthorized social security number is subject to deportation because the misuse is a crime involving moral turpitude under the Immigration and Nationality Act, the Fifth Circuit said Wednesday.
Under circuit precedent, the use of an unauthorized social security number categorically constitutes a CIMT because it involves intentional deception, the U.S. Court of Appeals for the Fifth Circuit said in a per curiam opinion, which acknowledged a circuit split.
