A Chicago man lost a bid to freeze a Illinois law restricting the possession and purchase of certain assault weapons while his lawsuit challenging the measure goes forward.
Plaintiff Javier Herrera’s motion for a temporary restraining order and preliminary injunction were denied because he’s unlikely to succeed on the merits of his lawsuit, Judge Lindsay C. Jenkins of the US District Court for the Northern District of Illinois ruled Tuesday.
The law is consistent with the nation’s “history and tradition” of treating particularly “dangerous” weapons as unprotected, Jenkins said, citing a 2022 US Supreme Court decision.
