Texas property owners who experienced flooding after Hurricane Harvey can move forward in their attempt to hold the Army Corps of Engineers liable, the Federal Circuit ruled.
The plaintiffs alleged a cognizable property interest in perfect flood control, according to the US Court of Appeals for the Federal Circuit. As a result, they can pursue takings claims against the federal government, the court said Thursday, reversing a lower court’s decision.
