Hulu Case Moved Out of Texas as Fed. Cir. Rebukes Albright Again

Hulu LLC convinced the Federal Circuit to intervene and move a lawsuit alleging it infringed media-routing patents from Texas federal Judge Alan Albright’s courtroom to California.

SITO Mobile brought its case against Hulu in the U.S. District Court for the Western District of Texas, where neither company is based. Albright abused his discretion in his analysis of all three factors that he said favored denying Hulu’s transfer bid, the U.S. Court of Appeals for the Federal Circuit said as it granted Hulu’s petition for a writ of mandamus.
