High Court Rejects Medical Product Maker’s Case Against HHS

The US Supreme Court announced Monday it won’t hear an appeal of an appellate court ruling that affirmed a lower court’s decision to dismiss a medical product manufacturer’s lawsuit that claimed the HHS improperly classified and reimbursed for company products without following proper procedures.

The February 2024 decision by the US Court of Appeals for the District of Columbia held the court lacked jurisdiction to decide the complaint by Regenative Labs, and that it should be “channeled through the Secretary’s administrative processes.”
