Gun Store Brings Jury Issue to High Court in Trademark Case

A Georgia gun store wants the Supreme Court to say it has the right to demand a jury decide its trademark infringement case, according to a petition filed on Jan. 25 (Clyde Armory Inc. v. FN Herstal S.A., U.S., 16-936, review sought 1/25/17).

Global firearms maker FN Herstal S.A., a supplier of arms to the U.S. military, won an infringement claim against Clyde Armory Inc. in 2015 for calling its aftermarket rifle stock “Scar.” FN Herstal, the nearly 130-year-old Belgian company—which also owns the Winchester rifle and Browning brands—markets a series of arms under the name Scar. ...
