Guantanamo Bay Detainee’s Due Process Habeas Claim Rejected

The due process clause’s protections don’t wholly apply to all detainees at Guantanamo Bay, because the scope of constitutional protections depends on “objective factors and practical concerns,” the federal appeals court in Washington ruled Friday.

Abdul Razak Ali has been held at the naval base in Cuba since 2002, after he was captured by U.S. and Pakistani forces. At the time of the raid, Ali was living in a guesthouse in Pakistan with an al-Qaeda facilitator and his associates, according to court filings.
