Government Scolded for Denying Asylum to Congolese Immigrant

A Board of Immigration Appeals’ decision to deny a Congolese immigrant’s request for asylum was based on a misinterpretation of precedent and imposed unreasonable conditions on those seeking relief in the U.S., the Third Circuit said Wednesday.

After the BIA’s handling of Bob Nsimba’s case, applicants would have to endure torture and arrest in their home country before being granted asylum in the U.S., and that isn’t the law, the opinion by Judge Theodore A. Mckee said.
