Goldman Sachs Seeks Quick Appeal Over In-House 401(k) Funds

Goldman Sachs wants an immediate appeal of a Manhattan federal judge’s decision green-lighting a proposed class action over the affiliated mutual funds in the investment bank’s 401(k) plan.

The dispute should go straight to the U.S. Court of Appeals for the Second Circuit for a ruling on two “case-dispositive” threshold questions under the Employee Retirement Income Security Act, Goldman says in an Aug. 14 motion for permission to appeal.
