Gannett Co. doesn’t have to face a proposed class action alleging it systematically discriminated against nonminority journalists by establishing a policy that required racial and gender parity throughout the workforce, a Virginia federal judge ruled.

The amended complaint filed by four men and one woman one year ago failed to assert the necessary ingredients for a class lawsuit under 42 U.S.C. §1981 against one of the largest newspaper publishers in the country, the US District Court for the Eastern District of Virginia said Wednesday.
