A conservative student group and commentator Ben Shapiro can’t pursue free speech claims against University of Minnesota officials for providing space for a speech by Shapiro at a venue that was smaller and more remote than the group requested, the Eighth Circuit ruled Monday.
The plaintiffs’ claim that the school’s “large scale event process” is unconstitutional on its face is moot because the university has since replaced that process with a “more defined ‘major events policy,’” the U.S. Court of Appeals for the Eighth Circuit ruled in a divided opinion.
