Flynn Intel Group Founder Gets New Trial in Foreign Agent Case

A Flynn Intel Group executive convicted of acting as an unregistered foreign agent on behalf of Turkey will get a new trial, the Fourth Circuit said Thursday.

The “key question in determining whether a new trial is warranted under Rule 33 is not what kinds of evidence support the verdict, but the weight of that evidence,” the US Court of Appeals for the Fourth Circuit said.

The government argued that the district court wasn’t permitted to base its new-trial determination solely on its disagreement with the jury’s inferences of guilt.
