Florida lawyers can respond to bad online reviews posted by third parties as long as they don’t reveal confidential information about clients or former clients, a proposed ethics opinion said.
Even though the person posting the review has no lawyer-client relationship with the attorney, the lawyer can’t throw caution to the wind when responding, the Florida Bar’s Professional Ethics Committee said Thursday.
“If a lawyer wants to respond to a negative online post by someone who is not a client or former client, the lawyer must still determine whether the response reveals confidential information about a client,” the committee said. ...
