Fiat Chrysler Loses Third Bid to Decertify Dart Owner Class

A Dodge Dart owner may continue to proceed on behalf of a class against FCA US LLC because he raised a fact question for a jury about an inherent defect in the cars’ clutch systems, a federal court in California said.

The ruling came in response to the automaker’s third bid for decertification.

The fact question supports Carlos Victorino’s injury allegations, and thus standing to sue, at the summary judgment stage of the litigation, Judge Gonzalo P. Curiel said Thursday for the U.S. District Court for the Southern District of California.
