Federal Laws Bar State Attorney General From Releasing Mortgage Investigation Files

The Washington state Office of the Attorney General cannot release to a third party loan files and other papers that it obtained from Ameriquest Mortgage Co. during an investigation into the company’s lending practices, the Washington Supreme Court unanimously held Nov. 4 (Ameriquest Mortgage Co. v. Washington State Office of the Attorney General).

The disclosure is barred under the federal Gramm-Leach-Bliley Act and the relevant Federal Trade Commission rule, Justice Mary E. Fairhurst said.
