Indian tribes can’t offer online bingo in states where gambling is illegal, the U.S. Court of Appeals for the Ninth Circuit said Aug. 2, deciding an issue of first impression.
The Iipay Nation of Santa Ysabel therefore can’t offer internet bingo to California customers, the opinion by Judge Carlos T. Bea said.
The Indian Gaming Regulatory Act allows tribes to offer bingo on tribal land, but the Unlawful Internet Gambling Enforcement Act says that a bet must be legal both where it is “initiated” and where it is “received.”
