FCA Loses Bid to Sanction Plaintiff Over Discarded Evidence

FCA US LLC lost its bid to sanction a named plaintiff for discarding evidence in a proposed class suit over allegedly flawed fuel pumps in some of the automaker’s Jeep and Ram vehicles.

Kevin Nestor and Jeff Withrow sued in the US District Court for the Eastern District of Michigan, alleging their vehicle’s CP4 fuel pumps failed because of incompatibility with US diesel fuel.

After the suit was filed, Nestor threw away documents about the purchase and maintenance of the Jeep, the court said.
