Ex-Fidelity Worker’s FMLA Retaliation Suit Advances Toward Trial

An ex-Fidelity financial consultant can head to trial with most of her suit claiming the company violated her Family Medical Leave Act rights, a federal court ruled.

Fidelity Brokerage Services LLC isn’t entitled to summary judgment on Sally Hogan’s retaliation and interference claims under the FMLA nor on her defamation claim, Judge Michael A. Shipp, of the US District Court for the District of New Jersey, said Monday in an unpublished opinion.

Hogan sued the company in 2022, alleging it fired her for taking medical leave to care for a sick child.
