Former Chicago City Council member Patrick Daley Thompson faced difficult questions at oral argument Tuesday as he asked the US Supreme Court to vacate his convictions for making false statements to FDIC contractors.
The justices seemed to agree that “false” and “misleading” aren’t synonymous, but struggled with where to draw the line between the two, given some overlap in meaning. Justice Neil M. Gorsuch said the answer could have much broader implications for criminal statutes using similar language.
There are a lot of federal laws criminalizing false statements that distinguish between “false” and “misleading,” Gorsuch said.
