EPA’s Registration for Citrus Pesticide Vacated by D.C. Circuit

The EPA’s authorization of the pesticide aldicarb to fight citrus greening in Florida violated the Endangered Species Act, a federal appeals court in Washington said, vacating the agency’s decision.

The Environmental Protection Agency asked the U.S. Court of Appeals for the District of Columbia Circuit to send the rule back to the agency without vacating it. The court said Monday the agency wouldn’t be able to timely reconsider the action, and that vacating the registration wouldn’t result in material disruption.
