Energy Suppliers Fail to Prove Arbitration Mail Got to Consumer

A Pennsylvania man who sued his former energy suppliers can proceed with claims of breach of contract and consumer protection law violations in federal court because he says he never received notices about arbitration that the companies say were mailed to his home.

Scott Panzer said his contract for electricity was transferred from his original provider to Oasis Power LLC in 2017 and then again to Verde Energy USA in 2018. The original terms of service to which he agreed didn’t include an arbitration requirement.
