The Energy Department pushed to dismiss a lawsuit from conservative-led states challenging its most recent efficiency standards for consumer conventional cooking products.
The department’s motion to dismiss filed Dec. 6 claims the states filed the petition for review “well past the 60-day deadline” to dispute agency rules. The petition also opposes a Federal Register confirmation notice for the rule filed Aug. 12—a notice that if vacated will “have no legal effect and therefore cannot redress any injury petitioners allegedly suffer,” the department says.
