Employer Must Pay for Its Own Defense in Breach of Duty Suits

Twin City Fire Insurance Co. doesn’t have to pay for its insureds’ defense in two breach of fiduciary duty class actions, even though the policy says it covers breach of fiduciary duty cases, a federal court said.

A different provision in the policy controls the outcome of the case, Chief Judge Matthew W. Brann of the US District Court for the Middle District of Pennsylvania said Thursday.
