EFF Lawsuit Challenges DMCA On Free Speech Grounds

The Digital Millennium Copyright Act’s prohibition against circumvention of digital copyright protection mechanisms is an unconstitutional restriction on free speech, the Electronic Frontier Foundation argued in a lawsuit filed July 21 on behalf of researchers (Green v. U.S. Dept. of Justice, D.D.C., 1:16-cv-01492-EGS, complaint filed 7/21/16).

The lawsuit claims that the restrictions are overbroad and interfere with protected speech, such as researchers publishing their findings on flaws in digital security technologies. The complaint claims that the process for determining exemptions to the law is also unconstitutional.
