EEOC Denied New Look in Walmart Pregnancy Accommodation Appeal

Wal-Mart Stores East LP’s win in an EEOC lawsuit over a Wisconsin store’s policy of providing temporary light-duty assignments to workers injured on the job but not to pregnant employees will stand.

The Seventh Circuit denied full court review in the case alleging the policy violated federal sex discrimination law.

The Equal Employment Opportunity Commission argued in its petition for rehearing en banc that a three-judge panel applied the wrong standard in an Aug. 16 ruling. That decision upheld a lower court’s grant of summary judgment to Walmart in the agency’s September 2018 lawsuit.
