Litigator Edward Carroll DuMont asked the president to withdraw his nomination for a seat on the U.S. Court of Appeals for the Federal Circuit Nov. 4, thus meaning that Obama again has one active judge slot to fill on the Federal Circuit.
President Obama first nominated DuMont 18 months ago to fill the seat vacated when Chief Judge Paul R. Michel retired from the bench. The president renominated DuMont in the new Congress in January, but the Senate Judiciary Committee never scheduled a hearing on his nomination.
