The Justice Department asked a federal appeals court to overturn the sentence of Sophie Roske, who pleaded guilty last year to attempting to assassinate Justice Brett Kavanaugh, saying the 8-year prison term she received was unreasonably low.
US District Judge Deborah Boardman placed undue weight on Roske’s personal characteristics—including her history of mental illness and transgender status—and did not properly apply a terrorism enhancement in varying down substantially from the guideline sentence in the case, the DOJ argued Monday in a brief to the US Court of Appeals for the Fourth Circuit.
