DOJ Says Justices Should Skip Student-on-Student Harassment Case

The Biden administration told the US Supreme Court it should deny Fairfax, Va.'s bid for review in a case involving a female high school student who says her school failed to adequately respond after learning a male student touched her sexually during a band class bus trip.

The Fairfax County School Board said in its petition for certiorari that Jane Doe’s lawsuit under Title IX of the 1972 Education Amendments Act raises two questions for review by the justices. Neither question warrants high court review, the Justice Department said Tuesday in an amicus brief.
