The Justice Department partially backed plaintiffs in a price-fixing suit against MultiPlan Inc. on Wednesday, sharing the agency’s view that use of a common algorithm can be the basis for a lawsuit under traditional antitrust laws.
The statement of interest, filed in US District Court for the Northern District of Illinois, is the latest development in multidistrict litigation against MultiPlan, which is defending against claims it used algorithms to suppress out-of-network reimbursements paid to health-care providers.
Gail Slater, the recently confirmed head of the DOJ’s antitrust division, is listed as one of the government attorneys on the brief.
