DLA Piper LLP had a victory in a $180 million malpractice suit against it snatched away when the Second Circuit ruled that the federal district court didn’t have jurisdiction over the case.
The district court said that it had jurisdiction over the case because it fell within the narrow category of state law claims presenting substantial federal issues and then dismissed it as time barred. But what mattered to jurisdiction was the importance of the federal issue to the federal system as a whole, Judge Reena Raggi said Monday for the US Court of Appeals for the Second Circuit.
