Divided D.C. Circuit Refuses to Rehear Bump Stock Ban Challenge

The federal government’s ban on bump stocks withstood another challenge Tuesday after a divided D.C. Circuit denied a petition to reconsider its decision to uphold the ban.

The petition for rehearing en banc came after the US Court of Appeals for the D.C. Circuit affirmed that bump stocks are covered by the definition of “machine gun” in the National Firearms Act of 1934. The statute became the basis for the Bureau of Alcohol, Tobacco, Firearms, and Explosives’ bump stock ban in the wake of the 2017 Las Vegas massacre that killed 58 people and injured hundreds more.
