The reckless misuse of client funds doesn’t always have to result in disbarment for negotiated discipline cases, the District of Columbia Court of Appeals said in the matter of a local lawyer who will instead be suspended for three years.
But the court stressed the narrowness of its ruling. “We hold that the negotiated-discipline process in certain circumstances permits some flexibility in determining the sanction to be imposed,” it said Thursday.
Paul Mensah admitted to acting recklessly with client money, not keeping proper records, and entering into a fee-splitting agreement with another lawyer without client approval, the court said. ...
