Defendant’s Blurry Picture Didn’t Tarnish Witness Identification

Using a poor quality picture of the defendant in a photo array didn’t violate his due process rights, the U.S. Court of Appeals for the Fourth Circuit said May 2.

The picture wasn’t overly suggestive and the identification was reliable, the opinion by Judge Albert Diaz said.
