Debt Collector Defeats Appeal in Lawsuit Over Invitation to Call

Collection agency Patenaude & Felix APC is entitled to dismissal of a proposed class action over a letter inviting recipients to call to “eliminate further collection action” because the letter doesn’t deceive debtors, the Third Circuit affirmed Tuesday.

Patenaude & Felix never said “explicitly or implicitly that the phone call would, by law” end collection efforts, according to the U.S. Court of Appeals for the Third Circuit.

The letter also doesn’t leave any confusion about whether a debtor should call or write to exercise their rights, the court said.
