A divided Washington federal appeals court upheld a trespassing conviction for a former New Mexico politician who became the first Jan. 6 Capitol rioter to be removed from his post under the Constitution’s ban on insurrectionists holding office.
The split three-judge panel for the US Court of Appeals for the D.C. Circuit rejected the appeal Tuesday from Couy Griffin, a leader for the “Cowboys for Trump” political group who was convicted for trespassing in restricted areas at the Jan. 6, 2021 riot at the US Capitol and sentenced to two weeks in prison.
