D.C. Circuit Rejects Challenge to Texas Nuclear Waste License

A federal appeals court rejected claims by environmental groups challenging a 2021 federal license of a privately owned interim nuclear waste storage facility in Andrews County, Texas.

The Nuclear Regulatory Commission reasonably applied its hearing regulations in the process of approving a license for Interim Storage Partners’ facility, the US Court of Appeals for the D.C. Circuit ruled in a per curiam order.

The court dismissed claims against NRC’s approval of the license because the court lacked jurisdiction to consider them and the environmental groups didn’t make adequate arguments to the contrary, it ruled. It denied remaining arguments, brought under ...
