CVS Glucosamine Supplement Consumer Deception Suit Reinstated

CVS Health Corp. faces a reinstated would-be class suit alleging it falsely markets glucosamine supplements, after the Ninth Circuit said a district court erred in dismissing the claims as preempted by federal labeling laws.

The district court relied on a preemption ruling in a different diet supplement case that doesn’t govern this one, the U.S. Court of Appeals for the Ninth Circuit said Friday.

Californian James Kroessler alleged supplement labels claiming the products support and maintain joint health are false because scientific studies refute them.
