Crime Hot Spot Theory Factored Into Upholding Protective Search

A judge on the DC Circuit used the crime hot spot theory as a factor to uphold a protective search in a high crime area of Washington, while the other judge that upheld the stop did all she could to distance the court from the theory.

The per curiam order Friday from the US Court of Appeals for the District of Columbia Circuit drew three opinions, two concurrences, and one dissent.
