Cox Urges Justices to Clear It of Copyright Liability for Users

Holding internet service providers liable for their users’ copyright infringement “defies common law and common sense,” Cox Communications Inc. told the US Supreme Court .

The ISP, whose case the justices agreed to hear in June, committed no affirmative acts as are required to find contributory liability, it said in its brief filed Friday. The US Court of Appeals for the Fourth Circuit remanded a jury’s $1 billion award in a suit brought by music publishers, but affirmed Cox’s liability by adopting a theory with “staggering” implications for ISPs that would lead to “dangerous and drastic consequences, the company said. ...
