Covid-19 Relief Forfeiture Order Gets Tossed by Eleventh Circuit

A forfeiture order in a fraud case involving two Covid-19-era relief programs was vacated by the Eleventh Circuit on Tuesday.

Judge Adalberto Jordan of US Court of Appeals for the Eleventh Circuit said the record didn’t support finding that Joff Stenn Wroy Philossaint could be ordered to forfeit up to the $3.85 million in loans issued under the scheme because he masterminded it. The government admitted that the amount, $673,210, was incorrectly calculated.

The Paycheck Protection Program and the Economic Injury Disaster Loan were adopted by Congress to help small businesses that faced financial challenges created by the pandemic.
