Courts Panel Continues Weighing New Amicus Funding Disclosures

Requiring groups that file amicus briefs to disclose different thresholds of funding by the litigants was among the ideas floated during a meeting of a US judiciary rules committee weighing a change to that policy.

The Appellate Rules Committee of the Judicial Conference, the judiciary’s policymaking arm, considered at a meeting Thursday the potential burden changes to amicus disclosure rules may place on filers and concerns about the ability of filers to get around new requirements.

Members ultimately indicated they would continue discussions to better refine a draft proposal.
