An Idaho law that prevents transgender students from using the restroom that is consistent with their gender identity was put on hold by the Ninth Circuit while it decides if the plaintiffs have a meritorious claim against its enforcement.
The order was signed Thursday by Judges William A. Fletcher and Mark J. Bennett. Dissenting Judge Consuelo M. Callahan said she would have denied the emergency order for an injunction pending appeal, because the students didn’t demonstrate “a sufficient likelihood of success on the merits of their appeal.”
